Terms of service

1. Parties & definitions

"TradeScorer", "we", "us", or "our" refers to PLURICHAIN CAPITAL, a French simplified joint-stock company (Société par Actions Simplifiée) registered under SIREN 834 341 620.

"You" or "User" refers to any natural or legal person accessing or using TradeScorer websites or products.

"Products" refers to TradeScorer-branded software tools made available through third-party platforms, including but not limited to Forge on TradingView (Lite, Signals, and Pro tiers).

"Website" refers to tradescorer.com and its subpages.

"Reseller" refers to the third-party platform through which Products are distributed and paid for, currently Whop Inc., acting as Merchant of Record (MoR).

2. Acceptance of these terms

By accessing the Website, creating an account, purchasing a subscription, or using any Product, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, the Risk Disclosure, and the Privacy Policy. These three documents together constitute the agreement between you and TradeScorer.

If you do not agree, you must not access the Website or use the Products.

3. Products and license grant

Subject to your full compliance with these Terms and timely payment of applicable fees, TradeScorer grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Products for your personal, non-commercial trading research and decision support, on the third-party platforms where they are made available (currently TradingView).

This license applies for the duration of your active subscription (Forge Signals, Forge Pro) or for as long as the free tier (Forge Lite) is offered.

The license does not grant you any right to:

• Decompile, reverse engineer, or extract the source code of any Product
• Sublicense, resell, redistribute, or share access with third parties
• Use the Products to provide signals, advice, or copy-trading services to others
• Build derivative or competing products based on TradeScorer outputs

4. Account and access

Forge is distributed via TradingView's invite-only mechanism. To receive access, you must:

• Hold a valid TradingView account
• Provide your TradingView username at the time of purchase via the Reseller (Whop)
• Maintain an active, valid subscription for paid tiers

You are responsible for the security of your TradingView account and for all activity on it. TradeScorer is not responsible for any loss resulting from unauthorized access to your TradingView account.

5. Payment, billing, and refunds

Paid subscriptions are billed through our Reseller, Whop Inc., who acts as the Merchant of Record. This means:

• The transaction occurs between you and Whop
• Whop is responsible for collecting and remitting applicable taxes (VAT, sales tax, etc.) according to your jurisdiction
• Whop issues your receipt or invoice
• Refund requests go through Whop's refund process, subject to Whop's terms and to our refund policy below

Refund policy

We offer a 30-day money-back guarantee on your first paid subscription. If you cancel within 30 days of your initial purchase of a paid tier (Forge Signals or Forge Pro), you can request a full refund through Whop. After the 30-day window, subscriptions are billed monthly or annually according to your selected plan and are non-refundable for the current billing cycle, but you can cancel future renewals at any time.

The 30-day money-back guarantee applies once per customer. If you re-subscribe after a previous refund, future purchases are non-refundable.

Subscription renewals

Paid subscriptions automatically renew at the end of each billing period unless cancelled. You can cancel renewal at any time via your Whop account dashboard. Cancellation prevents future charges; it does not refund the current period.

6. Permitted use

You may use the Products to:

• Receive algorithmic signals and analytics on the price charts you view in TradingView
• Inform your own personal trading decisions
• Configure parameters and customize the display within the Product's settings
• Discuss your experience publicly (reviews, posts, screenshots), provided you do not redistribute the source code or copy substantial portions of TradeScorer materials

7. Prohibited use

You must not:

• Share your access with anyone else (each subscription is for a single user)
• Resell, redistribute, or sublicense the Products
• Use the Products to operate a paid signal service, copy-trading service, managed account, or any commercial offering directed at third parties
• Attempt to copy, decompile, reverse engineer, or extract the algorithms behind any Product
• Use the Products in violation of any law or regulation in your jurisdiction
• Use the Products if you reside in a jurisdiction where their use is prohibited or where leveraged trading of futures is restricted
• Misrepresent your relationship with TradeScorer (e.g., claiming to be an official partner, employee, or affiliate without our written agreement)
• Use the Products to commit fraud, market manipulation, or any other illegal trading activity

Violation of any of the above may result in immediate termination of your access without refund.

8. Intellectual property

All intellectual property rights in the Products, the Website, the brand names "TradeScorer" and "Forge", logos, designs, source code, algorithms, documentation, performance statistics, and marketing materials are the exclusive property of TradeScorer (or its licensors).

You retain ownership of any trading data generated by your use of the Products (your trades, your account performance), but you grant TradeScorer a non-exclusive, royalty-free license to use anonymized, aggregated data for product improvement, marketing analytics, and research.

Trademarks of third parties (TradingView, Whop, broker names, etc.) are the property of their respective owners. We are not affiliated with these parties unless explicitly stated.

9. Disclaimers

The Products and the Website are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, to the maximum extent permitted by law. We specifically disclaim:

• Any warranty of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that the Products will be uninterrupted, error-free, or secure
• Any warranty that signals, scores, or other outputs will be accurate, timely, or profitable
• Any warranty regarding the performance of third-party platforms (TradingView, Whop, brokers) on which the Products depend

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall TradeScorer, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

• Loss of profits, trading losses, or missed trading opportunities
• Loss of data or business interruption
• Cost of substitute products or services
• Damages resulting from third-party platform outages, broker errors, or market events

Our total cumulative liability for any claim arising out of or relating to these Terms or the Products shall not exceed the greater of (a) the total amount you have paid TradeScorer in the twelve (12) months preceding the claim, or (b) one hundred euros (€100).

Important note for consumers in the European Union: nothing in this section limits or excludes liability for fraud, gross negligence, willful misconduct, death, personal injury, or any other liability that cannot be excluded under applicable mandatory consumer protection law (including French law for French consumers).

11. Indemnification

You agree to indemnify, defend, and hold harmless TradeScorer, its founders, employees, and affiliates from any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising from or relating to:

• Your use of or inability to use the Products
• Your trading decisions and resulting gains or losses
• Your violation of these Terms
• Your violation of any law, regulation, or third-party right

12. Termination

You may stop using the Products at any time and cancel your paid subscription via Whop.

We may suspend or terminate your access, with or without notice, if:

• You breach these Terms
• You engage in any prohibited use
• Required by law or by a regulatory body
• We discontinue the Product (in which case we will notify active subscribers and pro-rate refunds for prepaid periods)

Sections 8 (IP), 9 (Disclaimers), 10 (Liability), 11 (Indemnification), 14 (Governing law) survive termination.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email (if you have an active subscription) and/or posted on the Website at least 14 days before becoming effective. Your continued use of the Products after the effective date constitutes acceptance of the updated Terms.

The current version is always available at tradescorer.com/terms, with a "Last updated" date at the top.

14. Governing law and jurisdiction

These Terms are governed by the laws of France, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Products shall be brought exclusively before the competent courts of [Ville du siège social, e.g. Paris], France.

Important for EU consumers: if you are a consumer residing in the European Union, you retain the right to bring proceedings in your country of residence and to invoke the mandatory consumer protection laws of your jurisdiction. You may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
