1. Data controller

We are not required to appoint a Data Protection Officer (DPO) under Article 37 GDPR, but you can reach our privacy team at the email above for any data-related question.

2. What we collect

2.1 Information you provide

• Email address — when you join our waitlist, contact us, or subscribe to a paid product
• TradingView username — at the time of purchase, so we can grant access to the Pine Script indicator (collected via our Reseller Whop, then transmitted to us)
• Communications — emails you send to hello@tradescorer.com or privacy@tradescorer.com (the content of your message and any attachments)

2.2 Information collected automatically

• Aggregate analytics — we use Plausible Analytics to measure visits to the Website. Plausible is privacy-first: it does not use cookies, does not collect personal data, does not track users across sites, and is fully GDPR/PECR/CCPA compliant. Data collected is aggregate (page views, referrer, country, browser type) and cannot be linked back to you.
• Server logs — our hosting provider logs IP addresses for security and abuse prevention. These logs are retained for a maximum of 30 days.

2.3 Information collected by third parties

When you purchase a paid product, the transaction is processed by our Reseller, Whop Inc., who acts as the Merchant of Record. Whop collects:

• Payment information (credit card or other payment method)
• Billing details (name, address)
• Tax-related information required by your jurisdiction

TradeScorer does not see or store your full credit card number, billing address, or other payment details. We only receive: your email, your TradingView username, and confirmation of the active subscription. For Whop's privacy practices, see Whop's Privacy Policy.

2.4 What we do NOT collect

• We do not place tracking cookies on your browser
• We do not use Google Analytics, Facebook Pixel, or similar cross-site trackers
• We do not access your TradingView account beyond inviting you to the indicator
• We do not access your broker account, your trades, or your financial information
• We do not sell, rent, or share your data with marketers or data brokers

3. How we use your information

• Provide the Products — grant TradingView indicator access using your TradingView username
• Communicate with you — answer your questions, send important account or product updates, notify you of policy changes
• Marketing (with consent) — if you joined the waitlist, send you a notification when a relevant product launches; if you subscribed, occasional product updates. You can unsubscribe at any time via the link in every email.
• Improve the Products — aggregate analytics inform us which pages get traffic, which content resonates, and where the Website is broken
• Security & legal compliance — detect fraud, prevent abuse, and respond to legal requests when required

4. Legal basis for processing (GDPR Article 6)

Under the EU General Data Protection Regulation, we process your data on these legal bases:

• Performance of a contract (Art. 6(1)(b)) — processing your email and TradingView username to deliver the Product you purchased
• Consent (Art. 6(1)(a)) — sending you marketing emails after you join the waitlist or opt-in
• Legitimate interest (Art. 6(1)(f)) — aggregate analytics to improve the Website, security logs to prevent abuse
• Legal obligation (Art. 6(1)(c)) — retention of accounting and tax records, response to lawful regulatory requests

5. Who we share data with

We share data only with the following processors, and only to the extent necessary:

• Whop Inc. (Reseller / Merchant of Record) — for payment processing and subscription management. Whop Privacy Policy
• TradingView — to deliver the indicator access (we transmit your TradingView username only). TradingView Privacy Policy
• Plausible Analytics — privacy-first analytics, no personal data, EU-hosted. Plausible Data Policy
• Email service provider — [à compléter, e.g. Mailchimp, Resend, Postmark] — only if you opt-in for marketing emails
• Hosting provider — [à compléter, e.g. Vercel, Netlify, Cloudflare] — for serving the Website

We do not sell your data. We do not share with advertisers, data brokers, or any party not listed above. We may disclose data to comply with a lawful court order, subpoena, or other legal request, in which case we will notify you unless legally prohibited.

6. Data retention

• Email addresses — retained while your subscription is active, plus 12 months after cancellation. Waitlist emails are retained until you unsubscribe.
• Communication logs — retained for 24 months after the last interaction
• Server logs — 30 days maximum
• Accounting and tax records — retained for 10 years as required by French Code de Commerce
• Aggregate analytics — retained indefinitely (no personal data)

7. International transfers

Our hosting and some processors may be located outside the European Economic Area. When data is transferred outside the EEA, we rely on:

• Adequacy decisions of the European Commission (e.g., for transfers to the UK, Switzerland)
• Standard Contractual Clauses (SCCs) for transfers to other jurisdictions
• The EU-US Data Privacy Framework, where applicable

8. Your rights under GDPR

If you are a resident of the European Economic Area, the United Kingdom, or Switzerland, you have the following rights regarding your personal data:

• Right of access (Art. 15) — request a copy of the data we hold about you
• Right to rectification (Art. 16) — request correction of inaccurate data
• Right to erasure / "right to be forgotten" (Art. 17) — request deletion of your data
• Right to restriction of processing (Art. 18)
• Right to data portability (Art. 20) — receive your data in a machine-readable format
• Right to object (Art. 21) — object to processing based on legitimate interest
• Right to withdraw consent (Art. 7(3)) — withdraw consent at any time, without affecting prior processing
• Right to lodge a complaint with the French data protection authority, the Commission Nationale de l'Informatique et des Libertés (CNIL), or the supervisory authority of your country of residence

To exercise any of these rights, email privacy@tradescorer.com. We will respond within 30 days, as required by Article 12(3) GDPR.

For California residents: you have similar rights under the California Consumer Privacy Act (CCPA). Email us at the same address to exercise them.

9. Security

We use industry-standard security measures, including HTTPS encryption for all Website traffic, secure password hashing for any internal accounts, and access controls limiting employee access to personal data. However, no method of transmission over the internet is 100% secure. In the event of a personal data breach, we will notify the CNIL within 72 hours as required by Article 33 GDPR, and notify affected users without undue delay if the breach is likely to result in a high risk to their rights and freedoms.

10. Children

TradeScorer products are intended for adults. We do not knowingly collect personal data from individuals under 18 years of age. If you believe we have inadvertently collected data from a minor, contact privacy@tradescorer.com and we will delete it promptly.

11. Changes to this policy

We may update this Privacy Policy. Material changes will be communicated by email (for users with an active subscription) and posted on this page at least 14 days before becoming effective. The "Last updated" date at the top reflects the most recent revision.
